How Schengen Visa Code Article 5 Assigns Embassy Jurisdiction

Regulation (EC) No 810/2009 establishes three strict rules for determining the competent Member State. VFS Global, TLScontact, and BLS International intake officers verify your hotel confirmations against these rules before accepting your biometrics.

Article 5(1)(a)

1. Single Country Visited

If your entire trip takes place within a single Schengen country (even across multiple cities such as Paris, Lyon, and Nice), you must apply to that country’s consulate.

Article 5(1)(b)

2. Most Nights (Main Destination)

When visiting two or more Schengen countries, jurisdiction belongs to the country where you spend the most hotel nights — regardless of where your flight first lands.

Article 5(1)(b) & (c)

3. Equal Nights Tie-Breaker

If your longest stay is tied between two or more Schengen countries (for example, 5 nights in France and 5 nights in Spain), you must apply to the tied country you enter first.

Frequently Asked Questions: Schengen Embassy Jurisdiction & Hotel Bookings

Which Schengen embassy should I apply to if I visit multiple countries?

Under Article 5(1)(b) of the Schengen Visa Code (Regulation (EC) No 810/2009), you must apply to the consulate of the Member State that constitutes your main destination by duration (where you spend the most nights). Your port of first entry only determines jurisdiction if you spend an equal maximum number of nights in two or more Schengen countries.

What happens if I spend the exact same number of nights in two Schengen countries?

When two or more Schengen countries tie for the longest stay on your trip, Article 5(1)(b) and 5(1)(c) assign legal jurisdiction to whichever of those tied main-destination countries you enter first.

Can I apply to a different Schengen consulate just because VFS or TLScontact appointments are full?

No. Applying to a consulate without legal jurisdiction over your actual main destination is commonly referred to as "visa shopping." Consular officers cross-check your flight itinerary and hotel confirmations against Article 5 and will return or refuse applications submitted to the wrong mission.

How are days counted under the Schengen 90/180-day short-stay rule?

Under EU Regulation 610/2013, both the calendar date you enter the Schengen area (even at 23:50) and the calendar date you exit (even at 00:15) count as full days toward the 90-day ceiling within any rolling 180-day window. Therefore, a continuous stay of N nights spans N + 1 calendar days.

Why do stays longer than 15 nights require multiple hotel confirmations?

Each hotel booking confirmation on Reservation Points covers a maximum stay of 15 consecutive nights at a single property. If you stay in one country for 18 nights or split your trip across multiple cities, you need separate hotel confirmations so that every single night of your Schengen itinerary is documented without gaps.

Should my visa cover letter explain my multi-country Schengen route?

Yes. When visiting more than one Schengen country or entering through a different country than your main destination, your cover letter should explicitly list the nights spent in each Member State so the VFS Global, TLScontact, or BLS intake officer can immediately verify why that embassy has Article 5 jurisdiction.
